Marriage\ Family visa refusal

Post by mandapanda » Mon Feb 01, 2021 8:37 pm

hi all, I'm new to all this so I'm not sure if this in in the correct forum - please bear with me.
My son's girlfriend has just been refused an entry visa, coming from USA to UK to, hoefully, marry and settle here.
She passed the suitability, relationship and language parts of the visa, failed on the financial criteria. Reasons for this are ;
1. Bank statements not supporting payslips.
2. Missing employers letter.

In itself these issues do not seem insurmountable and they have been granted and appeal. How easy or otherwise is this process from your experience? How optimistic should we be?What steps can we take to increase chances of success?
Thank you in anticipation.

Why do the bank statements not match the payslips?

Employer letter is mandatory and cleared stated as such in appendix 1.7.

Appeals can take many months as there are delays.

Quicker to reapply.

Presumably this is a 6 month Fiance visa that has been applied for??

My sons pay/wages did not go into his bank, pay packet type thing, all above board just not the bank route; employers supporting letter - complete oversight - totally available.
Yes, a fiancee visa.

Wages that are not deposited in their entirety into the bank for every payslip are not counted towards the financial requirment. This would be disregarded in the same way as if he didn't earn the money at all.

An appeal will likely fail.

Is it best to reapply straightaway or try appeal and if that fails then reapply?
also, is a reapplication viewed any differently than 1st time round?
Thank you so much.

Best it to address the issues for refusal I.e. get his wages on pay slips and bank statements to match and meeting requirements and employer letter.
If then reapply and no other grounds for refusal they coast home free.
