ILR non-EU: Documents Required

Post by shrubstar » Wed Mar 31, 2021 2:44 pm

Hello,

I am a wee bit confused and my appointment is soon so I want to ensure I have the right end of the stick. I am applying for citizenship after having already obtained my Indefinite Leave to Remain [in 2014], and I am from Australia.

Documents required:

Proof of Lawful Residence - Indefinite Leave to Remain Card and passport with stamps covering the five year period to prove I was not outside the country during this time. Do I also need letter from employer? Is this to prove what I was doing in the UK or just to prove I wasn't outside of the country?

Proof of Application - Passport and Biometric/ILR card.

Referee forms with photos x 2

Student ID card and offer letter to prove I am currently studying - unsure if this is needed.

So as far as I understand from the checklist, these are what I need? I do feel a bit stupid seeing as they give us a checklist, but I am too confused! :?

Make sure you understand the residence requirements plus the requirement to be physically present in UK at the start of the qualifying period.

Yes, thank you. I have made sure I was physically here five days (EDIT: Five years!!! not days haha) on the day before my application and as far as I understand the passport stamps are enough to prove this?

Hello again,

Just a wee update. So I went to the appointment and the man said I did need a P60 or some other proof of residence - my passport stamps covering the 5 years were not enough he said. Unfortunately I didn't have any payslips or other employment proof on me so on his suggestion I madly tried to download my bank statements covering this period.

Now I'm a bit worried I'll be rejected, even though I have been living and working here completely legally. I did also have a proof of employment letter covering most of the five year period, so I'm hoping that combined with the bank statement and passport stamps are enough!! I definitely grew some grey hair during that appointment

Just posting here for anyone else who is concerned about this!

The person was wrong!
EU citizens use P60 to prove residency as they don't have passports stamped until recently.
Applicants with UK ILR provide their passports with any stamps in/out.
You should be fine. Maybe a complaint to UKVCAS may be in order (they are just agents, not UKVI staff).
This is just my opinion as a member of this forum and does not constitute immigration advice.
Please do not send me private messages asking for advice.

Okay, thank you! Yes, I was confused because I wasn't only basing this assumption of this forum thread - I swear it said that non-EU applicants could just use passports in the guidance. The UKVCAS staff made me panic as he also asked his manager. But you are right in saying they are not UKVI staff so are not really experts in this matter.

Thank you for the reassurance! They really need to give out correct advice.

As you received your ILR in 2014, there IS a requirement to prove your residence and that your ILR has no lapsed due to absence.
