Visa extension on basis of British born child

Post by Rsharma » Tue Apr 06, 2021 10:44 pm

Hi

I came to uk on 2.5 years spouse visa but my relationship is broken and my husband has filed a divorce case on me
I have got 1 year old baby who got british passport
Can i apply for visa extension as mother of british child
My visa is expiring in October 2021 so need urgent advice
As per https://www.gov.uk/uk-family-visa/child, i can apply but not sure my understanding is correct
On the same site,
Below is mentioned at https://www.gov.uk/uk-family-visa/partner-spouse

If you do not meet these requirements you may still be able to apply for a visa or extend your permission to stay if:

you have a child in the UK who is a British or Irish citizen or has lived in the UK for 7 years and it would be unreasonable for them to leave the UK
there would be very significant difficulties for you and your partner if you lived together as a couple outside the UK that could not be overcome
it would breach your human rights to stop you coming to the UK or make you leave
If you’re applying as a fiancé, fiancée
