You should satisfy the rules, you are not building an armour.
Cohabitation documents must cover the last two years. There is no specific requirement for cohabitation evidence

Dear Zimba,

Quick update - we have submitted my wife's ILR application/SET(O) on 20 April and have a biometric appointment next week. We have gathered most of the requirement documents, however, as mentioned earlier her police registration certificate was not updated with her PBS dependant extension visa (which was granted last March). We emailed police office last March, and again in November, but they were closed due to Covid. We have emailed police office again this week to see if we can get it updated before her biometric appointment, but they gave us an appointment only in June, which is no good to us.

My question - can we still go ahead with my wife's application for ILR without police certificate being updated, or should we update her certificate first? Is there anything in the rules which suggests we may be in trouble? We can attach a cover letter explaining this and also attach evidence of our email correspondence with police showing that we clearly tried to update her certificate on several occasions but it was not possible as police office was closed. Is this enough as an explanation of this issue? Technically, police's last correspondence from this week shows that they are open now and gave us an appointment, but it is a month away and we are keen to get her ILR sooner rather than later. Also, on the day of submitting the application, which was 20 April, police were officially still shut so if we go by the date of application we would not have been able to update the certificate by that date anyway (i.e. I understand that that home office considers all evidence up to the date of application, and not necessarily beyond that).

Please advice what is the best way forward.

Many thanks.

I already answered that when you asked initially. Nothing changes now. There is no issue

Hi Zimba,

Thanks for confirming this. The only issue is that when I asked this initially we were still in lockdown and police offices were shut. Now, technically, lockdown has ended and therefore could home office delay our application by saying that we have to update it before they make a decision...? Sorry if I am "over-asking" this.

thank you.

Dear Zimba.

Can you please elaborate your response a bit on why this should not be an issue for us? Will the HO really consider/accept our explanation that we haven't been able to update the certificate since last year (due to covid)? I would be really appreciative.

I was going through one of the HO guidances on grounds for general refusal, and one of them is failure to comply with conditions of stay (which includes police registration), and this is what made me pretty worried.

thank you for your patience with my questions.

Hi Zimba,

Basically, there is no need for us to delay the biometrics appointment (because of the un-updated police certificate)?

Thank you so much.
