Hi
I have an indefinite leave to remain (ILR) in UK which I acquired 10 years ago and was issued a Biometric Resident permit (BRP). ILR has no expiry but BRP is expired in the next 3 months so I have to renew it. The form I am filling now for renewal of BRP has three questions which I am confused with.
7.3 Have you, or any dependants who are applying with you, been subject to, or received, any other penalty in relation to a criminal offence; for example caution, reprimand, warning, or similar penalties in the UK or any other country?
7.7 Have you, or any dependants who are applying with you, been arrested and charged in any country with any criminal offence and are awaiting, or are currently on trial?
7.12. Have you or any dependants who are applying with you ever engaged in any other activities which might indicate that you may not be considered to be persons of good character?
The forms which I filled prior to 2012 (The year I got my ILR) never asked to declare any CAUTIONS so I never did that. In new form they have included it probably after 2013.
I had a police caution in 2006 for battery.
Then in Feb 2020 I was arrested for Public indecency (it was a false accusation) and the matter was withdrawn by procurator Fiscal and it was dismissed (I was not charged). In nutshell I was arrested but not charged.
Questions
1. Do I have to declare my Caution in New Form?
2. What Should be my reply to the following questions:
Have you, or any dependants who are applying with you, been arrested and charged in any country with any criminal offence and are awaiting, or are currently on trial?
Have you or any dependants who are applying with you ever engaged in any other activities which might indicate that you may not be considered to be persons of good character?
Will my declaring caution will have any effect on my ILR and Can it be revoked for deception (If there was no question related to ‘Caution’ How can it be deception but just curious?
