Child Passport: Proving ILR for EU resident prior to Brexit

Post by cubeen » Mon Jan 17, 2022 4:48 pm

Hello everyone,
Just a quick question regarding my application for a child.
Key Facts:
I have been in the UK since 2008 excercisising my rights (employment etc)
I have never applied for a blue EU permanent residency card
I have applied successflully for EU settled status granted on 04/12/2020
My child was born in the EU member state prior to that date

I wish to apply for a British passport for my child and require clarification regarding the following:
How to demonstrate having ILR (for myself) for the period prior to being granted EU settled status on 04/12/2020?
Did I only obtain ILR on 04/12/2020 when granted EU settled status?

Thank you so much for your help there!

Was your child born outside of the UK??

Your child, if born abroad, has not entitlement to a British passport, they are not British.

The child needs settled status first and one parent must be applying for or is already British and the other parent must hold settled status before you can register the child as British on form MN1. Once approved and you have the certificate, only then can the child apply for a passport.

Hi Thanks for replying
The question relates to the proving Indefinite leave to remain (ILR) for UK Permanent Residents from the EU for the time prior to Brexit.
My understanding is that if ILR of the parents is enough to apply for the British Passport for a child born aborad.
However the EU Settled Status was obtained after the child was born. Does this automatically mean ILR for the period prior to getting that status cannot be proven?
The child was born in 2015 abroad to the Parents fully employed in the UK since 2008 that only got their EU settled status in 2020.

No it is not. It is irrelevant to a child born abroad.

It is only relevant to a child born in the UK.
