Eligibility for a UK Job

Post by sargupta » Sat Jun 11, 2022 9:08 pm

Hi Experts,

I need your help.
I applied for a job and have successfully cleared mulitple rounds which took months. The eligibility criteria of the job says -
"If you are from outside UK, it is essential that you have indefenite leave to enter or to remain in the UK."

1) My current visa is "SPOUSE/PARTNER Leave to Remain". I was hoping that I will get ILR in next few months but due to personal family circumstances my spouse is in India and has not come to UK for last few years. I am in the UK with my child.
2) My solicitor told me that I cannot get ILR based on spouse's ILR because he is not in the UK but I can get another visa based on my child in UK who has a UK passport. My son is 10 years old living with me.

My query is, does that make me ineligible for the job I applied? The eligibility says "indefenite leave to enter or to remain", so does that only mean ILR? Please help because this job is really important for me.

Thank you.

Yes. "Indefinite Leave to Remain" is literally the full form of the abbreviation "ILR".

What is your spouse's UK immigration status?

Many thanks for your response.
My spouse is on ILR but he has not come to UK for more than 3 years due to personal reasons.
I believe I could get a visa based on my 10 years old child who is UK passport holder. This means again I will get another "leave to remain".

I am now worried about the eligibility of the job which I have almost qualified and my future plans are based on it.
My solicitor said that if my spouse travels to UK then I can get my ILR but I do not think he will.
The eligibility of the job - ""If you are from outside UK, it is essential that you have indefenite leave to enter or to remain in the UK."
Will "or to remain" not qualify me?

Thank you.

No it doesn't make you qualified. It is indefinite leave to enter OR indefinite leave to remain. In other words, no time limit on how long you can stay.

If your spouse has been absent from the UK for more than two continuous years, his ILR status will have automatically lapsed anyway.
