Spouse visa from Pakistan - Spouse not on ILR or British

Post by sheheryar_1408 » Fri Mar 10, 2023 12:58 pm

Hello everyone, maybe going out of topic. But if anyone can that would be great. I’m currently on the 10 years to route. I want to bring my wife to the UK from pakistan.
I earn more the 20,000£, my wife has done her english course, i have proof of residence, i have all the proof of our relationship also.
I just wanted to ask if i could apply for my wife visa. If i m not british or if i don’t have settlement like ILR.

If i can apply then Which route is going to be best considered for my wife? dependant/spouse/partner??

1. Do NOT tag your questions onto other members topics. It is considered rude.

2. You cannot sponsor your spouse for a spouse visa until you hold ILR.

3. On what basis did you get FLR(FP) 10 year route visa?

What is the reason you were put on this route? Eg do you have a British child? Were you in UK for 20 years? etc

Unfortunately you will have to wait till you have ILR before you can sponsor a spouse for a visa.

The UKVI website is very clear on who can sponsor their spouse and your visa route doesn't meet one of those listed.

https://www.gov.uk/uk-family-visa/partner-spouse
Apply as a partner or spouse
To apply as a partner, you and your partner both need to be 18 or over.

Your partner must also either:

be a British or Irish citizen
have settled in the UK - for example, they have indefinite leave to remain, settled status or proof of permanent residence
be from the EU, Switzerland, Norway, Iceland or Liechtenstein and have pre-settled status - they must have started living in the UK before 1 January 2021
have a Turkish Businessperson visa or Turkish Worker visa
have refugee status or humanitarian protection in the UK
The alternative is that they find a visa they qualify for themselves (Student visa, Skilled Worker visa etc) and apply for one of those if they meet the requirements.
