Hi all,

I just got my ILR decision via email today. My husband is British Citizen. Can I apply for naturalisation today itself or should I wait for the BRP to come through.

I had been in the U.K. for more than 5 years as a tier 2 dependent. I was just away from the country 3 times to visit my family (in 2017 for 3 weeks, 2019 for 3 weeks and 2022 4 weeks) and the duration for all the 3 occasions was not more than 4weeks. Completed my Life in U.K. and English language test.

Just asking as the price is going up from the 4th October 2023

You could apply today and use your ILR email approval as basis.
I had been in the U.K. for more than 5 years as a tier 2 dependent. As spouse of BC your residence period is only 3 years, working back from the application date.

Appreciate that but try not to rush and find mistakes later! Have you lined up your referees?

So if I am applying today, I have been in the U.K. for the last 3 years from today.

I was on holiday for 4 weeks in 2022 I hope that shouldn’t be an issue I guess.

I was on holiday for 4 weeks in 2022 I hope that shouldn’t be an issue I guess. That's less than 90days in last 12months requirement met, no problem.

You would be required to populate your ILR BRP number. Even though you can start filling up the form, you can't get past that stage yet. You need your physical ILR BRP to arrive.

Is it that clear-cut? Is BRP # a mandatory field?
Per the guidance https://www.gov.uk/government/publicati ... bookmark17 the following is stated in section "7.1 Showing you are free from immigration time restrictions" (amongst other options):
"Your biometric residence permit or any other documents confirming your right to remain permanently in the UK."
So a letter, email or even an old passport vignette should be acceptable?

I wouldn't say it's exactly black and white. You would be required to state and show evidence that you're free from restrictions on residing in the UK. The BRP is almost the "irrefutable evidence". Saying I got an email might still fly but I don't trust the delays that might come from that.
In that column, you just quote your ILR Brp number RT1122233UK. Easy for them to check.

If OP has waited for over 5 years (immigration journey), I see no reason why OP can't wait for a week or less more, to dot the "i's" & cross the "t's".

Also, in the Biometric enrolment section, OP would be required to populate the current and valid BRP number, issue date and expiry date. It get's tricky from that point on.

I have filled in the form and submitted it already.

I just received my BRP today, I will upload it as an extra document. Also my previous BRP is valid til March 2024.

I will frame out the exact question they asked me while filling the application.

Are you able to provide BRP card with this application? I selected- I don’t have a BRP for my most recent leave.

Do you have a BRP from your previous stay in the U.K.? I selected- Yes

Can you provide this with the application.? - I selected- Yes

Your previous BRP card would have been cancelled when ILR was granted.

Simply write a short concise cover note and explain. This really is not a big deal.

Hi,

My plan is to attach a letter along with the email confirmation that I received from home office stating I was successful on my application for my ILR.

And also send them my new BRP card
