You could apply today and use your ILR email approval as basis.
I had been in the U.K. for more than 5 years as a tier 2 dependent. I was just away from the country 3 times to visit my family (in 2017 for 3 weeks, 2019 for 3 weeks and 2022 4 weeks) and the duration for all the 3 occasions was not more than 4weeks. Completed my Life in U.K. and English language test.
As spouse of BC your residence period is only 3 years, working back from the application date.

I was on holiday for 4 weeks in 2022 I hope that shouldn’t be an issue I guess. That's less than 90days in last 12months requirement met, no problem.

Is it that clear-cut? Is BRP # a mandatory field?
I wouldn't say it's exactly black and white. You would be required to state and show evidence that you're free from restrictions on residing in the UK. The BRP is almost the "irrefutable evidence". Per the guidance https://www.gov.uk/government/publicati ... bookmark17 the following is stated in section "7.1 Showing you are free from immigration time restrictions" (amongst other options):
"Your biometric residence permit or any other documents confirming your right to remain permanently in the UK."
So a letter, email or even an old passport vignette should be acceptable?
