Qualifying period

I am applying for Naturalisation after I got my IRL 6 months back. In the form it talks about qualifying period of 3 years if you’re a wife/ civil partner of British citizen or 5 years if you’re not a wife of British citizenship. In the qualifying period of 3 years you are allowed 270 days outside uk and 5 years you are allowed 450 days. Now my husband got his citizenship two years back and I was on tier 2 dependent visa. Which one am I qualifying for? Also if I qualify for the 3 year period, I am overstaying outside UK by 10 days. Please help.

You can apply as a spouse, but you can try to apply in your own right as well - other foru

Have you reviewed the AN1 Guidance issued by UKVI?
The link will take you to the Absence rules, 10 days in the last 12 months is normally disregarded.

Recommend you also review all other sections. It should answer most questions but ask in this thread if anything else needs addressing. The date your husband became a British citizen is not relevant as long as he was British on the date you gained ILR.

Thank you. If I apply through the 5 year route do I have to wait for my one year ILR period? Or I can apply instantly? I got my ILR 6 months ago

If you decide on the 5 year route (not relying on British spouse) you would have to wait out the full 12 months.
On 3 years you can apply now, or could have applied 6 months ago.

Eligible for citizenship with ILR

Hello. A brief background. I was on tier 1 dependant visa and I have completed my 5 years. I recently got my ILR six months ago. My husband received his citizenship two years back. When I got my ILR he was already a British citizen. Now my confusion is if I am eligible to apply for naturalisation right away given that my husband is a British citizen or should I wait to complete 1 year of ILR in accordance to my 5 year route. Also what should I mention in my cover letter regarding my route .Please help. Thank you

You do NOT need a cover letter. UKVI know the nationality laws. Your route to ILR is completely irrelevant to British Citizenship application.
