I-867A

Post by graperson » Thu May 30, 2024 4:38 pm

Hello there guys.

Maybe someone can help me here.In June 2006 i was refused entry to USA under section I-867A. From 2008 i living permanently in U.K and im British citizen now. I want to apply for tourist visa. How i should approach that situation and how slim are my chances to be able to obtain tourist visa to US.
Any help is deeply appreciated.

That you were refused entrt before does not mean you will continued to be refused or denied.
It's a while ago and circumstances has changed I presume.
BC do not normally require visa to visit USA, ESTA application is what's required.
Could previous entry refusal over 10 years ago still be a factor? Hoping someone with similar experience or knowledge brings you more clarity.

I hate to scare you, but that is a dark place you don't want to be.
My take on what might have happened is;
You arrived in the USA. You probably lied at the port of entry to a CBP officer about your intentions. Maybe you planned to work in the US or live there illegally for a while (shooting the breeze here).
He took you in for further scrutiny and interrogation. Probably kept you in a holding cell until they could get you on the next plane back to where you came from.
Your passport would have been defaced with "EXPRO June/06, I-867 served".

You've naturally triggered a 10 year ban to the US. Arguable that it expired in 2018. But your ESTA wouldn't be smooth sailing anymore.

The only way to know for a fact is to try again. If you try once and it fails. Don't try twice! Go apply for a visa at the US consulate.
No sin in failing, you just have to try and try again!
