Graduate visa refusal due to fee wavier application

Post by skhan323 » Sun Apr 13, 2025 1:16 pm

I Need to Share My Story – UK Graduate Visa Refused on a Technicality

After years of hard work, I completed my MSc degree in February 2025 — but my Graduate Route visa (PSW) has just been refused by the Home Office due to a technicality under Immigration Rule GR 10.2(a).

Here’s what happened:

I failed one module and was supported by my university’s wellbeing services from Sept 2023 to Feb 2025.
The university initially assured me that they would support a visa extension but reversed this on the last day before my visa expired.
I immediately submitted a fee waiver application, while waiting to resit my final exam.
I passed my module on 13 February, my result was confirmed on 17 February, and university confirmed home office about course completion on 21 February and I applied for the Graduate visa on 23 February.
At the time, my fee waiver was still pending — on 10 March I got email from home office that they not considering my fee wavier application as I have lodge a paid application now so they will be now considering that but the Home Office refused my PSW application, claiming I no longer had valid leave due to the gap which was from 4 Feb to 23 Feb (the time I spend on fee wavier), and accused me under GR 10.2(a), and invalid my fee wavier and consider the time spend on fee wavier as overstay.
now I want tosubmitted an Administrative Review to challenge this. I never lied or hid anything — I acted in good faith and followed every step honestly.will my admin review any chance to be successful?

No. You were not eligible for a fee waiver, so applying for it was a waste of time and a clear attempot to try to buy time before making the Graduate application.

Unsure what do you want to achieve from a JR.

The decision you received from UKVI is clear, you were not eligible for neither a fee waiver nor a Graduate visa. If you read the article above, what you did is a form of deception which is a serious immigration offence. They also are telling you that you're an overstayer, another serious offence.

If I was you and to avoid making this situation even worse I would leave the UK asap, and then see options for an appropriate visa (skilled worker, etc) from the home country if you want to come back - provided UKVI haven't yet penalised you for what you've done.

I agree with you but in the situation I did the fee wavier was not planned as time buying its was the very last moment I have to avoid myself from overstay.
