12 Months Rule before applying for ILR on the basis of 10 years

Post by nasir_skp » Mon Jul 14, 2025 1:21 am

Hi,

My friend's 1st extension under the FLRFP (10 year route) is expiring next month in mid August and need to apply for the 2nd extension.

His 10 years are completing in February 2026.
I have read somewhere that the applicant must have held their current immigration permission for at least 12 months before applying for ILR. I am confused about this rule and need some clarification.

Scenario 1: If the 2nd extension approves for instance in December 2025, can he apply for the ILR 28 before the 10 years time complete in Feb 2026 or Does he need to wait for another 12 months to apply for ILR in December 2026?

Scenario 2 : If his 2nd extension applications remains pending with the Home office untill Jnauary 2026, can he apply for the ILR 28 before the 10 years complete in Feb 2026? Would that 12 months rule still apply in this case ?

Please help?

It technically only applies to people who moved to a NEW immigration route on or after 11 April 2024 :!:
An extension generally means someone has remained under their route for more than 12 months, so this rule does not apply to them.

Read item 4 here: Lawful and continuous residence changes to Long Residence route from 11 April 2024
