Child MN1 application -Overstaying - dependent visa expires

Post by Ba3113 » Wed Apr 08, 2026 11:00 pm

I’m looking for some advice regarding my child’s immigration status.

Both parents now have ILR, and our child (4.5 years old) was born in the UK. The child is currently on a dependant visa, which is due to expire in about 3 weeks.

We are planning to apply for British citizenship registration using Form MN1. However, we understand that the decision process may take several weeks or months, and the child’s visa will expire during this time.

My questions are:
• Will the child be considered an overstayer while the MN1 application is pending?
• Are there any consequences or penalties or deportation etc for the child due to overstaying in this situation?
• Could this affect the citizenship application outcome or any future immigration matters?

I’d really appreciate any guidance or shared experiences.

Technically yes -however a child born in the UK doesn't need a visa or ILR for registration as British
• Are there any consequences or penalties or deportation etc for the child due to overstaying in this situation?
no - see above comment - note however that NHS services may likely become chargeable for the child so best to arrange extra health insurance to cover this.
• Could this affect the citizenship application outcome or any future immigration matters?
no - a British citizen is no longer under immigration control.

I’d really appreciate any guidance or shared experiences.
