Spouse visa extension with DLA and UC

Post by Silentguru » Wed Jun 10, 2026 11:13 pm

Hi guys
I want to praise u all how you guys are helping and guiding people like me .
I want an opinion for my MRS spouse visa extension
I am British citizen with 2 British child and my wife is on spouse visa which is about to renew in December 2026 .
Our one child is with disability and I am receiving high value DLA for my child with UC as well from June 2025 .I am taking care of my child .
I am self employed and has maintained more than £18600 threshold
Do I need to maintain threshold 18600 after also ?
My question is
I was filling visa extension form and there’s one section says if the sponsor is receiving any special benefit like DLA

Definitely I will say yes because I am claiming DLA from last year June 2025 of my son plus same time I was started claiming UC however I was declaring my monthly profit £1600 to UC and so maintaining £18600 as well .
Would my wife extension remains the same of 5 years route or it will now change to 10 year family route because of DLA and ÜÇ claims also she is included in the claim but not receiving anything on in her bank .
Please advice
Thanks

YOU are not claiming DLA and haven't been awarded DLA. Your son has been given DLA and you are in a way merely administering it for him. I think the answer for that question with regards to DLA should be "No".

You can mention the Universal Credit, but I suspect that that won't be relevant.

The reason for that question is that if the *sponsor* (you, in this case) is in receipt of certain benefits, the threshold for income goes down from the Minimum Income requirement of £18,600 (as was) to adequate maintenance.

If your son, not you, is in receipt of DLA, that does not affect the change and your wife will still need to meet the £18,600 income threshold, if she qualified under that in the past.

Insofar as the DLA is paid into your bank account then you would qualify for the exemption from the minimum income requirement and instead have to show adequate maintenance and accommodation in which UC can also be considered as income. That’s because Appendix FM states receiving one the listed benefits rather than entitled to, so it must be paid into the sponsor’s bank account. You’ll see that child disability payment, the Scottish child DLA equivalent is also listed.
