Skilled Worker Dependant applying for ILR after sponsor became British citizen

Post by Aaditya84 » Thu Jul 16, 2026 9:36 am

Hi everyone,

I'm hoping someone has been through a similar situation.

Timeline:

* I came to the UK on a Skilled Worker visa.
* My wife joined me around 3 years later as my Skilled Worker dependant.
* I obtained ILR after completing my qualifying period.
* About 2 years ago I became a British citizen.
* My wife has **remained on the Skilled Worker dependant visa throughout** and has **never switched to a spouse/family visa (Appendix FM).**

She's now reached 5 years as a Skilled Worker dependant and is eligible to apply for ILR.

My question is:

Should she apply using **SET(O)** (PBS/Skilled Worker dependant settlement), or because I'm now British should she instead use **SET(M)**?

My understanding is that because she has always remained on the Skilled Worker dependant route, she should still apply using **SET(O)**, even though I have since become a British citizen.

Has anyone been in this exact situation recently? Did you use SET(O), and was your application straightforward?

Thanks in advance!

It is Set O.

The form is determined by the dependent VISA route and not by YOUR current status.

Set M is ONLY for those who have been on the 5 year FLR M visa route, or 2 x 2.5 year spouse settlement visas.

There is nothing unusual about your circumstances either.

Brilliant! Thanks a lot!

Just to confirm, the field where it asks for my passport details will be the British Passport and not the Indian Passport (which is no longer valid).
