Moving to Swiss after submitting Naturalisation application?

Post by mr_pankaj » Tue Jan 20, 2009 10:15 pm

Hello All,

I need your advise regarding the following case of my wife.

She,
Arrived in UK: 13-MAR-2005
Recieved ILR: 21-MAR-2005

Me:
Arrived in UK: 17-APR-2001
Recieved ILR: 21-MAR-2005
Now, I hold a British Passport.

I am aware she is elligible for British citizenship.

We are considering moving to Switzerland(for atleast 12-months) to take up a job there.

Now, as I hear that Naturalisation is taking slightly longer time(i.e. 3-4 months), can I get my wife to apply for naturalisation (by sending her documents through check-and-send service) and move with me to swiss?
The tricky bit here is, that she has recently returned from a 90-days long break from India (i.e. Oct2008-Dec2008) {Also, she has not been outside UK for more than 270 days in the last 3 years.}

So, please advise if its the correct way for us to send her naturalisation application (with a local address in it) and move to switzerland on her indian passport (the job agency is sorting out her stay visa in swiss) until she recieves a letter from Home office that she can book a appointment for Naturalisation in which case she will temporarily come back to UK to take Naturalisation and also apply British passport, after which she can rejoin me in switzerland.

Apologies for making it too elaborative, as I just wanted to ensure I have not left out any useful piece of information which may be vital for you to suggest correctly.

Many thanks in advance.

Pan,
Funny I'm also in a similar position to you,in so far as to say I will be applying for naturalisation on the 26/01/09 and I will be joining a Swiss company on the 1st April 09.
In may case we are going to wait until June/ July, before we leave the sunny shores of England, by which time our naturalisation process should be completed.Meanwhile I will be commuting Geneva/London.

But back to your situation, I would wait until your wife has completed the naturalisation process .
Two reasons for this:1)She has to demonstrate her comitment to living in the UK and if you use any Swiss address they will blow your application out of the water.
2)The move to Swistzerland as a non EU citizen can take 4-5months to process and of course as a EU citizen a matter of hours.

Good luck

HI Siggi,

Unbelievable! I thought I am the only one stuck in this weird situation but clearly I am not alone.

Yes, I am going to keep local address in her passport to avoid any suspicion to the case worker.

Do you know how much time is it taking these days right from applying for the naturalisation to getting naturalised (i.e. recieving naturalisation cert.)?

Also, once she has applied for naturalisatin process can she travel to swiss on schengen visa ? If so, would the time with me (in swiss) be counted as the days outside UK even though she will do that only after sending her documents visa check-and-send service?

Please suggest.

many thanks
Pan

PS: Please PM me if you like, after all we both in the same boat :)

Hi Pan,

How long doe's it take from appliction date till final Naturlisation?
Differcult one to answer as no one can say, but anything from 4 to 6 months.

Once she has made her application, time out of the UK is of no interest to the HO.

Yes and she will have to use a multi entry Schengen visa to move in and out of Switzerland.
