Hi There,

Just a few facts about myself.

applied @port 1995.

refused 1996.

appealed....refused 1999.

made fresh representations in 2002.

Nothings happened till last year,when i got MP involved and they wrote back and said to him i was legacy and my 2002 application still under consideration.

MP told me to contact him again aroun end 2008,eary 2009 if i heard nothing from HO-did just that...maybe coincidence...but today issued with IS96 and asked to report once a month starting next month.

Is this normal. ? is it std proceudre as maybe i was "off the radar"?

Have one child born here (18 months). mother not available to help as she's illegal.

Whats going on?

As a passenger arriving at a port of entry, subsequently refused asylum and entry to the UK, you are liable to be detained. The form IS96 is an extension of an IS96 which was probably issued to you when you were released following your original arrival in the UK. If you fail to report as required by the IS96 you can be arrested and detained anywhere where you come to notice.

It is likely that UKBA are now in a position to make a decision about your case and wish to maintain contact with you. It is not a good idea to fail to comply with the IS96.

So this is procedural. I will definitely report. I wasnt thinking not to-actually.

What would chances be for a long-term person for ILR, considering the facts i aforementioned.

Your nationality?
Are you a family unit with the mother and child?
Mother's nationality? Has she made herself known to UKBA?

I doubt whether you can benefit from the "14-year" concession under Para276B i(b) of the Immigration Rules because your refusal of asylum notice in 1996 will have also notified you that you were refused entry to the UK, and therefore liable to removal.

yes we are a family unit.

we got married in the uk in 2004 and i did send my uk marriage certificate plus my baby's birth cert to ho.

they have written to my MP and stated im a Legacy Case to be decided by 2011.

could the issue of my new IS96 mean that they are actively looking at my case. and since i have fresh representations made in 2002 which they have never considered , under legacy case- does it still mean the beginning of an asylum process -Again????!!!
