Hi,

Thanks in advance for trying to help me with this query.

Date of Arrival in the UK: 4/11/04 (on Work Permit)
Later changed from WP to the then HSMP which is now valid until 5/10/09

Based on dates I gather I complete 5 years on 4/11/09 and hence eligible to apply for ILR 28 days prior to 4/11/09 i.e. I guess 7/10/09.

My concerns are: Am I eligible to apply for ILR on 5/10/09? I understand it falls two days shy of the 28 day mark but is there a clause that lets me apply or do I have to apply for an extension for my existing visa. Also, does the fact that my existing visa does not cover the entire 5 year period i.e. not valid until 5/11/09 but only 5/10/09 have a bearing.

Damn...

How frustrating. I believe you will have to extend your visa first, before even considering to apply for ILR, which would then mean that your second question would no longer be an issue.

Glad we agree on the frustrating bit..!!

I guess that means I pay 750£ to extend my visa for another month..!! and then again pay another 750£ for ILR...Way to go ME...!!

You are eligible to apply for ILR on 06/10/2009. Please start sorting the Tier 1 documents now! Very importantly is the maintanance funds which they are using to refuse applicants enmasse. You can apply for TIER 1 any time from now so long as you have enough points on all requirements. That way, you have enough time if you are refused for whatever flimsy ground they can find and still reapply and be ready to get your ILR on 06/10/09 at PEO.

You will pay £750 just to get an extension of one (1) day. and pay another £950£ if you apply at PEO (which I would advice is better than paying £750 by post) Good Luck.

Just a quick question, I double checked my arrival date and the immigration stamping is i.e. date of arrival in UK is 03/11/04 and the FLR is valid until 05/10/09. Does this mean I'm eligible to apply for ILR on 5/10/09 in person at the PEO?

Just trying to save 750 quid and also some headache if possible..
