Next step after 4 years on HSMP?

Post by kiwiskilledmigrant » Sun Feb 01, 2009 4:27 pm

I first joined the HSMP programme in Feb 2005. After extending my visa in 2006 for 3 years it is now up for renewal. I am unsure which visa i am now able to apply for as the rules have changed a few times between my arrival in the UK in 2003 and now. Overall I have spent 4 years on the HSMP preceded by 20 months on a working holiday visa. At the time the working holiday visa counted as eligible time in the UK towards Indefinite Leave to Remain. Am i now able to apply for ILR or do I need to get another tier 1 (HSMP) extension before applying for ILR?

Hi,

WHM period is not counted in ILR. Just check the documents again on bia website. You will have to apply for one more HSMP Extn to Tier 1 but the good news is that you are covered in JR section of HSMP extn. Just refer to Judicial Review section on the BIA website...

All the best..
