Turkish citizens with permission to work in the United Kingd

The European Community Association Agreement (ECAA) with Turkey allows citizens of Turkey the right to have their application to establish themselves in business in the United Kingdom considered under more favourable rules. A Turkish citizen who is legally here in another capacity may therefore apply to stay for this purpose.

A decision by the Association Council of the agreement also gives certain rights to citizens of Turkey who are already legally working in the United Kingdom.

If you are a Turkish citizen legally employed in the United Kingdom because you have a visa that gives you permission to work, you may:
apply for further permission to stay in the United Kingdom after working here for one year, so that you can continue to work for the same employer, if a job is available;
change employers after working here for three years, provided you continue to work in the same type of job and your employer tried to hire a European Community citizen to do the job but was not able to do so; and
work in any type of job for any employer after four years.

I wonder if anyone knows the clause "If you are a Turkish citizen legally employed in the United Kingdom because you have a visa that gives you permission to work" covers turkish citizens currently residing in the UK on a student visa.

A student visa does not confer the right to work; it allows work to be undertaken subject to conditions and is incidental to the main reason for the visa - to study.

In other words there is no upgrade available from a student visa through the Ankara agreement to set up in business.

Well actually it only says "a visa that gives you permission to work" it does not say "visa which confers the right to work"...

Interestingly I came across some solicitor firms offering service to apply worker visa (not business) with Ankara agreement for student or aupair visa holders who worked continiously for a year for the same employer.

I wonder there is anyone tried this route?
