Applying for ILR, wife stay less than 2 years

Hello friends,

I entered UK on 08-May-2004 with WP and I have moved on to HSMP in Jan-2007..

Now I'll be completing 5 years of stay by 07-may-2009 AND I can go for ILR. I have got married on 01-March-2008 and my wife came on Tier1 dependent, which means by the time I apply ILR(MAY 2009) my wife will have have only 1.2 years of stay in UK, which means she is not eligible for ILR

Please suggest me

To what status my wife's visa will be changed when I go for ILR application as she is not eligible for ILR by May-2010

Does not matter how long your wife is in the UK, you apply your ILR together with her. Both of you need to pass LITUK test.

But how about the rule that Wife should have 2 years stay before she can appply for ILR

If married to British. Try it. I got my wife's ILR when she was just 1yr 8 months in the UK, I was five years then on WP.

I think there is a diff b/w applying as a HSMP/TIER1 or on WP i'll suggest you to get the info from HO and see what they say

You can include your wife even though she came after you. The difference will be when applying for naturalisation. Thats when you both have to satisfy the 5year residence rule. The slight difference being that your wife can naturalise after 'just' 5years whereas you would have had to wait 6years
