Hi

I am in UK since 12 months and also have a Indian income as a self employed .

I spoke to home office about whether Indian income can be consider and what about multiplying factor .

Ho said there is no hard and fast rule any where mentioned about this and

it would be discretion of case worker to decide .If your application is first time for tier1 like switching to the tier 1 ,he would go to supportive documents for your overseas income and if case worker approves that then he will apply multiplying factor for your overseas income otherwise
not .

Anyone has any experiance about overseas income eventhough someone is in UK since last 12 month

please help

I got my Tier 1 yesterday. I have been in UK for the last 4 years working for an Indian IT major. I receive a UK salary and a portion of my Indian salary as well. I had claimed points for my UK salary + Indian salary with uplift.

In my case, they have not considered the uplift factor applied to my indian salary as i have been in UK for the last 12 months. However, they have converted my indian salary directly to pounds and added to my income calculation.

I had claimed 85 points and was awarded 80 points. so it was not an issue in getting the visa.

is that any rule where ho say you cant uplift indian income if you are in UK.

would you mind to give reply

UKK,

I never came across a rule as such in this regard. The explanation in the letter i received from HO was quite detailed. Their argument was:

Uplift is essentially to cover for difference in cost of living. Since i am living in the UK, my cost of living is as per UK standards, not India.

Well then its quite clear ,but I dont know one solicitor guarantee me a visa and i came to know one guy from this forum who got visa with uplift ratio.

Any way I appreciate your letter but what would be chance if u challenge them in Appeal .

With arguments that there is no clear explanations in immigration rules .

what would be chances for victory
