confused !!

Post by louellan » Mon Jul 20, 2009 3:16 pm

I have been granted a settlement with intent to marry visa and have now moved to the United Kingdom to be married on the 25th of July. I was told by the UK consulate in Australia that once I am married to my partner (who is a UK citizen ) I would then have to take my marriage certificate and visa to the UK embassy to have it changed to a spouse visa in order for me to stay here for 2 years then I could apply for the ILR. My confusion is I have rung the UK border agency and was told that in order for me to do anything I would have to go back to Australia to apply for my next visa then another company told me it could be changed for a fee of 700 pounds I was not told this by the Austrain / UK consulate they said it was a simple changover.. I am very confused and am hoping someone can help me with this.

thanks

Did you apply for a fiance visa which would give you 6 months in which to marry and then after the wedding apply to the Home Office for Further Leave to Remain - FLR(M)...which is a 2 year spouse visa.
Or...did you apply for a Marriage Visit Visa which is intended for someone who wishes to marry in the UK but isn't going to settle in the UK after the wedding.
What code is on your entry visa? How much did you pay for your visa?
There is a fee involved in transferring to Further Leave Spouse, which is
processed by the Home Office, not the British Embassy. Postal applications are £465, or an application in person is £665

My Visa is a 6 month visa so i guess it is a fiance visa although on my passport visa they attached it says marriage/cp i am not sure where to find this code you mentioned ..sorry ... i am concerned about costs it did cost me $1200 australian dollars for this visa and was under the impression it would not cost so much to have it changed to the spouse visa.

Did you apply though a solicitor? because 6month visa doesn't cost that much!

I applied through the British high commission in Australia and had to do an online application to do so, they sent me a costing of it and took a credit card payment. I was in constant contact with them and was told that once i was in the UK and married all i would have to do is take my cert and passport for a simple change of visa's the actual name of the visa applied for on my application was marriage with intent to settlement

You were given incorrect information regarding the process. You need to complete form FLR(M) which you can download from the UKBA website,
and either submit it by post together with the documents listed, or apply in person at a PEO...prior appointment only. Fees as given in my previous post.
Remember that you won't be able to legally work until you have been granted your 2 years Further Leave. Postal applications are taking around 3 months to process.
