ILR documents for spouse

Post by Nazz » Mon Jul 27, 2009 12:50 pm

Hi

I am in the process of applying for ILR for my wife after her 2 year spouse visa

Regarding the documents that we need to prove that we lived together for the past two years, the lawyer told us that we need the following

The dates of the letters or documents should spread over the whole 2 years. They should be from at least 3 different sources.

Question: Do we have to include documents for each month for the past two years?
My wife might not have documents from 3 different sources for each month, but she certainly has documents for each month from two different sources. Will that be a problem? she has HHS letters spreading over 2 years but not for every month.

Are the above documents enough for both of us? My main concern is that my wife may not have for each month documents from 3 different sources.

You only need 6 documents in total spread over the full 2 years from 3 different categories. If you don't have any in joint names, submit 12.
Hopefully your lawyer realises that you don't need documents for each month of the 24!
Has she passed the Life in the UK test yet?

Documents for wife

Post by Nazz » Mon Jul 27, 2009 8:10 pm

hi

Thanks for the reply, we have loads of documents which span over 2 years but not in joint names.

she did pass the life in UK test.

One other thing that is bugging me is that the lawyer wants the tenancy agreement and again it is in my name only, a silly mistake should have been in both names.

Does the home office insist on Tenancy agreement even if we provide Documents from three diffrerent sources?

SET(M) applications for ILR don't require Tenancy agreements. This is for
the initial spouse settlement visa. Include 12 documents then if all you have is in single names. One question...is your lawyer (I assume you mean Solicitor or Immigration Advisor) a specialist in Immigration, or OISC registered if an Advisor?

Yes they are registered with OISC. Thanks for the advice but if you look in the Set M application, section 10-Documents, they do mention tenancy agreement, so I don’t know why the lawyer is insisting on this, maybe it is because me and my wife don’t have documents in joint names

Tenancy agreement is only mentioned as an example of what type of document is accepted to prove address. However, as you have a solictor you really need to take his advice...that's what you're paying him for.
I assume that your solicitor feels that the tenancy agreement will strengthen your application.
