Guidance Note V8.0

Page 11 point 73

To qualify for settlement in the UK you
must have spent a continuous period of
five years in the UK in a category
leading to settlement

Page 13 point 88

This is otherwise known as indefinite
leave to remain or settlement. The
main criteria for settlement will be that
you have spent a continuous period of
five years in the UK in a category
leading to settlement. You must also
be able to demonstrate that you can
continue to be economically active in
the UK as a highly skilled migrant.

Page 13 Point 87

If you have been granted permission to
stay in the United Kingdom as a Highly
Skilled Migrant for a total of five years
and wish to remain in the UnitedKingdom on a permanent basis you
can apply at the end of the five-year
period for permanent residence


Considering All the above i believe we had legitimate expectation of getting ILR through this 5 year path. So i think HSMP post November 2006 and Tier1 as well with guidance Version 8.0 Should be safe

Can any senior members or moderators comment please

At this point no one can say anything, it would be just a speculation, until new rules of ILR/citizenship come in force during next year. Only after that there might be possiblity of new inclusions/exclusions, etc. Let us see what coming years will bring.

This page explains how the Government's new earned citizenship system will work.
There will be three routes to citizenship:
Work - for highly skilled and skilled workers who are in the United Kingdom under Tiers 1 and 2 of the points-based system);
Family - for the family members of existing British citizens and permanent residents; and
Protection - for refugees and migrants who have been given humanitarian protection.
For all of these routes, there will be three clear stages which a migrant must complete.

So in bold letters one can clearly see that following rules are for Tier1 and Tier2 of points based system. and we are under scheme of HSMP not Tier 1 or Tier 2 so i am now 100% sure that we are safe enough.

But what bout when we need to extend under Tier1........

well if u r HSMP initially then u will never get extension under Tier1 system because pre Nov 06 are all covered under JR.

Yes i am HSMP but Post Nov 2006.... but never the less my point is HO clearly say Expectation from RULES IN PLACE WHEN they joined the scheme... So the joining date for even HSMP Post Nov 2006 and all Tier1 is in the past..... They can't change the rules for that time now for any one wheather it be HSMP post Nov 2006 OR Tier1
