WHM VISA to TIER1 GENERAL VISA to ILR

Post by rahult2020 » Tue Oct 20, 2009 6:46 am

Hi,

I stayed in UK under working holiday maker visa(as you know WHM is 2 years visa) for nearly 15 months. In that 15 months I worked for 12 months continously which I am allowed to do legally. As per the new Tier 1 rules I came back to India(need to go back to home country and apply for Tier 1), I came here and applied for Tier1 general visa at hyderabad. I got my visa stamped on 25th,Sept of which my visa starts on 10th october(the date I asked them while filling the application). Everything is so fine till now.

I have a few questions regarding Tier1 General visa to ILR status.

1) Will my stay under WHM(working holiday maker) be counted for ILR?
2) I am planning to go back to UK only after March,2010. I read in many posts that there is no specific time limit for entry. But my question is whether my time clock for 3 years count starts from the day I entered into UK or the date it was stamped?
3) if the count starts only the date I entered into UK, Can I change the stamp expiry date?

Please help me.

Regards
Rahul

if you have got visa then you should come here a.s.a.p as Tier 1 is a kind of visa where you work and live here and adopt to the UK while mingling with the culture and thats what they want to see.

on the other note, i belive you cannot be out of UK for over 3 months but I ain't sure.

your time for ILR counts when you arrive in the UK, not your visa stamp date. I don't suggest trying to change the date now, there are loads of people trying to just get approval the first time. so count your blessings and don't push your luck, is my sincere advice.

Thank you all for the reply.

Few questions are left unanswered

1) what is the maximum number of days I can be in India after my Tier1 is issued?
2) If the time clock of my Tier1 visa starts after the day I entered UK, can I change the date on visa stamp after I go to UK or do I need to apply for an extension again?
