expired hsmp / valid student visa

expired hsmp / valid student visa

I had a student visa valid until 12/2010. I obtained my HSMP inAugust 2007. Unfortunately when I was renewing my HSMP, I didn't read the guidance notes and submitted print out of online bank statements instead of paper statements. My application was refused. I appealed. Thank God my appeal was allowed three weeks ago.
There are delays from the HO side and I didn't get contacted regarding my visa yet. I've tried to contact HO by tel, fax and email without any benefit. I need to travel to brussles this weekend. I'm not sure if I can still use my old student visa to come back which is on the passport. Can Anyone help advise me if I can travel??

I think there would be no problem in travelling as yo have a valid visa on your passport, so you can use it. To be on the safe side, you can also take that letter of "appeal acceptance" with you. Your student visa is valid until the Tier 1 visa is stamped on your passport. The stamp of Tier 1 visa will override student visa.

Would not the student visa already have been invalidated by the HSMP visa issued in 2007 ? I think the risk is that leaving the UK may, in itself, constitute abandonment of the pending appeal. AG

You are right gordon, the most recent visa will invalidate any previous visa/s. As OP was saying that his student visa was valid until 12/2010, so I thought that it was the most recent visa. But, it is not the case and in this case, OP should not travel.
