Out of UK for 1+ years - is HSMP still valid?

Post by goldfish » Wed Nov 04, 2009 9:59 am

I have an HSMP visa valid to Feb 2011 (this is original HSMP, not Tier 1). I have been living outside the UK since Jan 2009 and I am planning to return in Jun 2010. This will be approx 18 months away.

Is my HSMP still valid? Will I encounter any issues when I try to re-enter?

Will I have issues when I apply to extend the visa in Feb 2011?

(I'm aware of the rules for ILR so not asking about those - just re-entry and extension.)

You can enter UK till the last date of ur Visa validity.. the immigration officer may ask the reason for the delayed entry.. you can give a gentle reply something like recession, jobs not available etc. etc..

For Extension you will not have any issues if you can get required earnings points and have maintenance funds etc etc..

Did you visit UK after you received your initial HSMP?

Good Point Sushil:

And i think YES;

On page 30 of the Application:

http://www.ukba.homeoffice.gov.uk/sitec ... l-form.pdf

Which says..

C) Is the applicant currently in the United Kingdom under:
Tier 1 (General) or the Self-Employed
Lawyers Concession or the Writers,
Composers and Artists provisions of the
Immigration Rules
- go to Section 3B
The Highly Skilled Migrant Programme - go to Section 3C

And Section 3C asks/gives for all the Age, qualification, Earnings etc.. points
BUT, i would wait for some seniors to confirm this.. which would be good for you n me aswell.. :D

Thanks, you have really brightened up my day!

I lived in the UK for 3 years before moving to Asia for a while.

As my extension would be under original HSMP I don't think there is a specific earnings threshold for me to meet, but I'll be making sure I meet the new (and old) criteria just in case.

Thanks lots :)
