Earnings for the past 12 months

Hello all

I am aware that for HSMP, we need to show the earnings for the past 12 months. I am working with an organisation and my payslips are monthly. Does it mean that e.g I apply in the last week of Nov, I need to show my payslips till Oct? Also, in case I apply in Dec, can i still show my payslips for the period Nov 08 - Oct 09, as if I show the payslips for Dec 08 - Nov 09, I fall short of the earnings and hence do not have the 75 points.

How is the law interpreted in such case?

How is the law interpreted in such case? What law?
