Tier1 Dependent visa rejected

Post by pinnacle123 » Sat Nov 07, 2009 12:40 am

Hi,

I am currently on Tier 1 General visa and have been staying in the UK for the last 3 years. I want my wife to join me in the UK.

She applied for her Tier1 general dependent visa in Sept09 from India and British High Commission rejected because of low maintainence funds. It was surprising as I sponsored her and gave 3 different bank/building society statements for the last 6 months with good enough balance. It seems that the Visa officer made a mistake and only looked at 1 statement and that too the one with lowest balance.

There was no provision of making an appeal. My wife then applied for tourist visa so that she could visit me for few months, go back to India and re-apply for dependent visa. Now, this time her tourist visa also got rejected as Visa officer is not satisfied that she intends to go back to India before expiry of tourist visa. This time she is given an appeal form along with the rejection letter.

I am not sure what is the best option for me at this stage. Since her visa has been rejected twice in the last one month, I am really cautious this time. Should I make an appeal or apply fresh for dependent visa or is there any other option?

Could anybody please advice?

Many thanks,

Appeals generally take longer than 2-3 months. When you use multiple bank accounts for your maintenance funds, you should make it absolutely clear that you meet the maintenance funds creteria by using "combined sum" of all bank accounts. You also need to make sure that your combined sum of all bank accounts must not go below the required amount at any given moment of time.

For tourist visa rejection: Since you got your tier-1 dependent rejection and you applied after a short time, that might have raised alarms in caseworker's mind.

Paste rejection statement so that other members can comment.
