Can a Tier 1 visa be extended after 5 years

Can a Tier 1 visa be extended after 5 years

Hi guys

Since there is no time frame on when you enter UK but its said its better if you enter before 6 months after your visa is stamped, I have a question on how the settlement works
Lets say in 5 years , I have been absent from UK for about 150 - 200 days which is fine.
But consider this, I have my visa stamped for 10 Sep 2008 and I enter on 1st Nov 2008 almost after 2 months so which means I am not eligible for ILR.
Can I get apply for FLR in that case and then apply for ILR once I meet the 5 year criteria.

Hi krisbal,

No offence. But, I think the way you've framed your question can be a bit complex to understand.

If I am not wrong your major concern is to know if you would be able to extend your Tier 1 visa even after you've missed the 2 initial months?

I would say 'Yes, you can' and that is only on the condition if you meet all the required criteria laid down by the Home Office at that point in time.

As for your second prospective question, you might want to check the guidance notes for 'qualifying period' for applying for settlement/indef leave to remain in the UK, using this link.

I've used the guidance notes for Form SET(0) as you've mentioned that yours is a Tier 1 visa, please note that these forms and guidance policies differ with 'Application Types', see the link below for more information.

Hope this helps, I know all these ever changing policies can drive one insane, but in my opinion it's always best to keep up with the game.

Hey thank djzack. Yea rules keep on changing.
But my concern was second extension which I need to do anyways.
So I guess I will have to go thru the entire Tier 1 extension process which was what I wanted to know.

It is recommended to arrive in UK before 28days once ur visa is stamped

- It is not fine, for ILR at present you should not be out of UK for more than 180days in the 5years and not more than 90days in a year or at a stretch

Yes you can by current rules!

Guidance Notes for Settlement P-3
If you entered the UK with a visa several weeks or more
after the date from which it was valid for use, you may need
to apply for an extension of stay to complete the relevant
qualifying period
