Dependent Visa of Tier 1 Holder

Dependent Visa of Tier 1 Holder

I live in the UK and recently changed my VISA from Tier 2 to Tier 1. My dependants, wife and kids still hold Tier 2 dependent visa. Can they travel out of the country with their Tier2 dependent Visa.

They are in India on Vacation planning to join me in May first week.

Since you are no longer on Tier 2 leave, IMHO your dependents must apply for leave to enter as Tier 1 dependents before they travel to UK.

They are going to join me only early next year.

But they are planning to visit me in coming May.


Can I bring them on Visitor Visa.

Sorry, I missed reading the fact that your dependents were still in the home country. Hence I have edited my earlier response.

If your dependents enter UK on visitor visa, they will not be able to change their immigration status from visitor to Tier 1 dependent from within the UK. They will have to return to home country to apply for EC again (as dependents of Tier 1 migrant).

Thanks Guru for your prompt response. My family will be here only for 3 weeks and go back to India. Then apply for Tier 1 dependendent Visa.

hope this should be OK and won't create any issues in the future for PR processing.

Visitor visa will reset their ILR count.
Dependents of Tier 1 migrants must live in UK for 2 years (as dependents) before becoming eligible for ILR. Any stay in UK on a visitor visa during this 2 year period will break the continuity and reset their ILR clock.
