Tier 1 General from US - Is W2 accepted by the Consulate?

Post by ssiva77 » Wed Mar 03, 2010 5:34 pm

I submitted Tier 1 Visa application to the Chicago Consulate as per the following details:

On-line application: 11-Feb-2010
Fees Paid : 11-Feb-2010
Bio-Metrics taken: 19-Feb-2010
Application and original docs mailed: 21-Feb-2010
Date Docs Received at
Chicago Consulate: 25-Feb-2010
Date Entered for Assessment: 25-Feb-2010

Points claimed:
Qualification (ICWAI): 35 (Masters)
Previous Earnings: 45
English Language: 10
Funds Maintenance: 10

I provided the following evidences to prove the points claimed:

1. Qualification - Original Degree Certificates for ICWAI & CA along with Marksheets

2. Previous Earnings:

a. Original W-2 Statements generated by my Employer for the 12 month period - Jan '09 to Dec '09
b. 12 months Original Bank Statements that clearly show the Salary deposit made every fortnight for the period Jan '09 to Dec '09

3. English Language: B.Com - Bachelor degree is listed in the Naric calculator and gives me 10 points, original degree certificate with marksheets were given as evidence

4. Funds Maintenance:
a. Original Bank Statements above for the last 4 months before application
b. Electronic Bank Statements duly attested with Seal ONLY by the Bank Branch (no Signature)
c. Visiting Card of the Bank official
d. Average Balance Certificate for Funds maintained for the last 12 months under Bank Seal

Now I am not worried much about points 1, 3, 4 above but I am very concerned about the Previous Earnings, after reading many posts in this forum.

My Employer is a large IT company and provides ONLY Online payslips, and doesnt provide any Letter confirming Gross or Net earnings. In the forums, I found that many folks have their application rejected because W2 is not considered a valid evidence unless stamped with IRS Stamp.

However the Tier 1 Guidance Note (page 25 of 44), clearly states that "a document produced by an employer as an official
return to a tax authority, showing details of earnings on which tax has been paid in a tax year (for example a P60 in the United Kingdom);"
is an evidence. This means that the Employer generated document is a valid evidence.

I have clearly stated in my covering letter that my employer doesn't provide online payslips and I have provided the following annexures:

1. Letter from HR department confirming my current valid employment
2. Letter from the Payroll Department confirming that they dont provide payslips and the undersigned can be contacted by anyone to verify
about me and my earnings.
3. A statement of Reconciliation of Earnings between the W2 and the Net Amounts Deposited into bank accounts
4. A statement of fortnightly deposits into the bank accounts which can be verified with original bank statements
5. last 4 months online payslips as an additional proof, of which the payslip ending 31-Dec-2009 contains the summary of Gross and Net earnings for the Period Jan '09 to Dec '09, however this is not attested or signed, but only an online printout.

At this stage, after reading the forums, I am very much worried that my application would get rejected because the Consulate doesn't
consider W2 as a valid evidence of Earnings and only Payslips or Employer Letter would be sufficient evidence. Is this true ?

Questions:

1. Is W2 acceptable as a valid evidence if the periods match with bank statements?
2. If I have provided detailed Reconciliation statements explaining how the amounts in the W2 match with the bank statements to the penny, will that be considered adequate?
3. What are your thoughts on my application getting rejected or approved?
4. What should I do if my application gets rejected?

Thanks
Shiva

W2 - NOT ACCEPTED AS EVIDENCE - ONLY PAYSLIPS OR EMPLYR LTR

Post by ssiva77 » Thu Mar 04, 2010 10:55 pm

W2 NOT ACCEPTED AS EVIDENCE, only EMPLOYER LETTER OR 12 MONTHS ATTESTED PAYSLIPS are acceptable - Please see Notification from Consulate
==============================================================================================
Dear Mr XXXXXXXXXXXX

We recently received your visa application. However it was noticed that one of your documents submitted in support of your application did not meet the requirements as listed in the guidance. Specifically:

You have provided your W2s, however, they cannot be accepted as they do not match exactly to the deposits in your bank account. The letter from your employer cannot be accepted toward your earnings as your gross and net earnings have not been stated. Also, we acknowledge that you provided a letter from your employer authenticating your payslips, however, your payslips must be stamped and signed. Therefore, you will need to provide either a letter from your employer, or stamped and signed payslips.

Exceptionally I am writing to advise you, and to request that a corrected original document be sent by hard copy to us at the following address:
XXXXXX
XXXXXX

If an adequate document is not received within four working days of the date of this notification your application stands to be refused. If the replacement document still does not meet the requirements as per guidance, the application will be refused.

Please mark the envelope with XXXXXXXX in large black print on the top right hand corner. Failure to do so may mean the application is refused.
We look forward to receiving your documents.
