HSMP Circumstances Changed ... Please help

Hi.
My father got HSMP visa with the family and we came here in UK in 2004 and after 2007 we will be completing our 4 years time. My mum, brother and sister are here with me staying. Me and my brother are above 18 years of age, after when we got our Entry Clearance we got our visas extended though we turned 18 and applied as depandent of my father.
But unfortunately my father passed away few days go. I was wondering if we would still be eligible to apply for Indefinite Leave after 4 years i.e., after 2007.

Please advice.

Very sorry to read about your personal loss and the circumstances you find yourself in.

Most commonly, family members i.e wife and children get their residence visas, extensions and ILR because of their dependence status on the main applicant. This unfortunatly is no longer the case with you. I would advise you to approach an immigration consultant rather than looking for an opinion from this forum. People frequenting this forum have more run-of-the-mill problems while yours is a little more complex.

I am tempted to say that dependents will not be able to apply for ILRs on their own, but then again, I dont know if there exists any concessions for circumstances such as yours. The HO will have other issues like the fact that two of you are no longer dependents and the financial viability. If you know any lawyer then contact them or less you can look for one at www.oisc.co.uk
