1. my child was born in germany and she has a german travel passport. when we first came to uk, she did not need any visa. as a turkish national, we granted WP with my wife, then switched to hsmp. on our 3rd year, we got a turkish passport for my daughter and when we are switching to tier-1, i have applied for her as well. she got a dependant visa on her turkish passport now till 2012. this summer we will apply for ILR because we will complete 5 years. but my daughter's visa is only 1 year old, can we apply for ILR for her as well?
2. as she had german passport, we were thinking that she had rights to apply for child benefit. we applied and we are paid for 2 years. but now I am unsure about that so I called HMRC and suspended this. HMRC told me that they will check this again. How should I tell this to HM when applying for ILR?
