Do we qualify as EEA

Post by cubba! » Wed Apr 14, 2010 9:36 pm

I am writing regarding a possible pending EEA application and a few questions that have arisen - we have read the information provided at www.ukba.homeoffice.gov.uk but are unsure we interpret this correctly.

1) I am a Swedish citizen by birth but have since acquired Australian citizenship and am also, currently, residing in Australia. Am I still considered an EEA national?

2) My de facto partner of seven years is an Australian citizen; with the intention of moving to the United Kingdom, to live and work, do we qualify under the EEA category and should we in this case apply under the EEA2 category? Both application form and guide seem to imply the EEA national as having to currently reside in the UK, hence the above question.

3) Should I not be considered an EEA national, as per item number one above, would this change were I to move back to Sweden or would I need to reside in said country for a period of time before making application?

4) Would both applicants have to provide proof of comprehensive medical cover as supporting documents?

Any help with the above questions would be much appreciated.

Cheers

Thanks for the reply.

I've had dual citizenship since 2007.

After spending most of last night reading posts on the forum, it would seem we are not eligible to apply under the EEA2 category.

If I understand things correctly, we are, however, eligible to apply for an EEA family permit. As an EEA national (I take it my current residency in Australia and dual citizenship does not change the fact that I'm an EEA national) I would submit an application for the EEA family permit, stating that my de facto partner and I will be travelling together. This application should, in all likelihood, be approved unless they have questions regarding the validity of our relationship.

Upon entering the U.K. we would then be able to apply under the EEA2 category - if I'm not mistaken, and as an EEA national, we could prove that I am exercising treaty rights as a job seeker. Regardless, my partner, non-EEA national, would be allowed to work under the family permit whilst awaiting the EEA2 to be granted.

Much appreciated if anyone could please advise whether this interpretation is correct or not.

Cheers
