How to re-register child in mother's correct name?

Post by breanna » Wed Sep 22, 2010 5:29 pm

I would appreciate some help or advice for a friend please. My friend has been here for approximately 8 years illegally. When she arrived her ex partner told her not to transact any business in her correct name. She took his advice and registered with the doctor with a bogus name. Six years ago she had a child and registered the child in the bogus name. Two years ago her ex-partner (child's dad) ask her to give him full access to the child and to sign a court document that the child lives with him permanently. He told her this was to enable the child to get a British passport. They both went to court and she signed the document in the bogus name. The child received the British passport. The ex-partner does not want to give her access to the child anymore because the relationship is now over between them. My questions are:

1) How can the child be re-registered in the mother's name?
2) Does the mother need a solicitor to represent her?
3) If the mother needs a solicitor, what type of solicitor does she need and any suggestion of solicitor's name or firm will be grateful.
4) How can the mother get back access for the child.

She is from the Birmingham, West Midlands area. She is devastated at the moment and keeps breaking down in tears. She now wants the child to be back in her custody full time.

With no document to link the child and the mother (real identity), paternity test may be the only way forward. If father has the sole responsibility of the child he may not agree to paternity test, and therefore, a court directed paternity test may be required.

Do take into account that in taking this route the mother will have to acknowledge that she has been living in the UK under assumed identity.

The mother definitely needs expert legal advice from a competent solicitor on the matter.

IMHO ...
