Advise on COS for tier2

Dear friends
my psw expires in Feb11. Wasn't lucky enough to manage a work permit under tier2 so far. One of my friend owns a restaurant, and he said that he can give me a job as a chef and apply for tier2...he sponsor ship license with A ratings. But...the problem is...
he wanted to get someone from india. he applied for COS. unaware of the 3 months time period, it lapsed. again he applied for one more COS, and tried to get the candidate from india, but it went to appeal in india. In this situation I need your advice about the possibility of another COS. Is there any possibility to get one more COS stating the first one is lapsed or any other way to get it as I was told by one of my friends that its not possible to get more than 2COS on these type of restaurants. Can anyone please advise me.
