No I-94 to submit I-9

Post by wickedkaleidoscope » Tue Jan 04, 2011 9:18 am

Hello,

I work for an IT co. and I travelled to US last year for about 15 days on H-1B during which I was to be on the payroll of our US company. Due to some confusion I was not able to submit by I-9.

Now, that I'm back in India I have been asked to submit the same to my employer in US with a note saying why it was delayed, which is OK.

However, the section 1 of I-9 asks for the details about US status. I would select the option "Alien authorized to work in US" with the Admission # and expiration date.

I do not have the two above details. Neither did I retain a scanned copy of the passport with the I-94 attached before coming back to India.

What I do have is an SSN number (which I applied for in the two weeks I was there) and stamp from Homeland Security that I entered US.

Now, my employer says that they will not be able to carry out the Everify process and this would result into scrutiny when I enter US again.

What can I do to ensure that the EVerify is carried out?
Is a copy of I-94 or the Alien Admission # mandatory for EVerify?
Can my employer carry out EVerify through SSN?
Is this the scrutiny also applicable if I enter US on another Visa OR another emloyer?

Please advise or let me know who I can contact...
