define treaty rights

Post by limarian » Sun Apr 24, 2011 7:49 pm

can somebody clarify for me the definition of Treaty Rights - does it include being self - sufficient' ie if i can prove that i gave my relative enough money to live on during her stay - does that show she was exercising her treaty right. Is there some source definition somewhere on the home office sites - thanks steve

If this relative is your Thai aunt married to a French man, it is what her husband did that matters. Someone would need enough money PLUS comprehensive health insurance (not the NHS) to be self sufficient.

Thanks, Her husband at the time - now divorced, was a labourer - they did not part on good terms as he refused to sign her eea1 - he won't help her with any paperwork now and she has been deported back to Thailand as her application for dependancy, on me and my wife, failed. As her son in law, i regularly gave her money while she stayed with him, so she never needed any more funds. I can show I have funds to support her now, but i guess that's irrelevant if there is no way to show her husband supported her during the marriage. and no, she didn't have private health insurance. although on the one occasion she had to visit a doctor i paid for it privately. Are the Treaty Rights defined somewhere. I would like to read what is says. Nobody has been able to give me the same detail as yourself - they just say TR means 'self sufficient or self employed', but don't define exactly what that means

regards
Stephen
