Please help in unusual situation -BC application

Post by mego_1980 » Sun May 29, 2011 12:40 pm

HI everyone,

I am going abroad in the same day after applying for the British Citizenship. I will apply on thurdsay and hopefully HO will receive it on Friday and my flight will be on this thursday in evening time. is it okay or not?

as i am going for emergency trip for 20 days and my solicitor will send it on behalf of me.
please read below from AN Guidance:

You must submit your application as explained above. You should not send an application direct to the Home Office if you are outside the UK at the time you make the application - even if you normally live there. The date of application will be the date your form is received by the Home Office or the local British government representative as shown above. It is not the date on which you send it. This means that you need to make the application from the country where you will be when it is received. Therefore, it is not advisable to send in your application if you are about to leave the country as it might not be received until after your departure and it will be invalid.

Your early reply much appreciated

Thanks

No, and the text you quoted explains the reason why.

Apply after you return.
Life isn't fair, but you can be!

You can but why take a risk if it doesn't reach the HO on time? wait until you return.

There is no discretion with this requirement. Failing to meet it, and you lose your application fee. I hope your solicitor has explained this issue to you. Otherwise he is not doing a very good job.

But you do need to provide "Advance Passenger Information" to the airline for flights into/out the UK. They might not check and not catch you but are you willing to risk £800 for it? Just wait 20 days.

UKBA has all the data on ' who leaves ' and ' who enters ' the UK.

Do you really want to take a chance and fail on this requirement?
