Age Points

Post by tier1extension » Tue Jun 07, 2011 12:59 pm

I applied for my initial Tier 1 General application in 2008 and I got 10 points because it was after my birthday when I applied. Had I applied before my birthday I would have gotten 20 points.

I am now applying for my Tier 1 General extension application and the UKBA points based calculator is stating that if my current age is 30 years old (because I am applying early and before my birthday) at the time of my current application, I would get 20 points.

However, in page 30 of the Tier 1 General Application Form, it is stating to click the age points you got in your initial application.

Under the rules when I applied in 2008, it states that if you are 30 years old when you apply for extension you will get 20 points. This is what the points based calculator stated.

So should I tick 10 points since that is what I got in my initial application or should I tick 20 points because I am still 30 years old and show the printout of the points based calculator?

What is the "all other applications for leave to remain" section in G1 page 30 of the application form for? Is that where I should tick my answer?

You will get the same number of points for age as per your initial application. The calculator has a big disclaimer and refers you to the policy guidance in case of doubt. As per the policy guidance, you get the same number of points as per initial application (same as per the application form). Guidance overrides calculator if there is a conflict.

Age points rules in 2008

Post by tier1extension » Tue Jun 07, 2011 3:05 pm

thanks for reply! but i thought same rules will still apply as back in 2008 when i first applied for my tier 1 general visa? at that time, the rule was that for extension applications, you get 20 points if you are 30 years old. shouldn't that rule still appy as what the calculator is using as well?

thanks for reply. however, the link that you provided simply proves that you can at least claim same age points as your initial application. but could you claim higher age points than your initial application if you apply for extension early, such that you will be younger and acoording to rule back then, if you are 30 years old in extension time, you will get 20 points? the points based calculator calculates based on your current age when extending but form seems vague and only refer to initial points. also, what is that "all other applications for leave to remain" area under age points?

:) No.

Forget the PBS calculator, and focus on what the "law" states. Rather than depending on a piece of software, refer to the policy guidance. Will help you understand how the rules apply.

It seems you are falling short of points to qualify for extension, hence hell bent on claiming more points.

Guidance cleary states an applicant will get same points for age when extending, that were given during initial application.
