Hello Everyone

Back again in the forum for some piece of advise:

Am on ILR via Spouse Route; Unfortunately things havent been well with my husband whereby we have separated now

My questions: Due to financial position this has pushed me to, looking for help with Housing Benefit and Working Tax as am on low income now. I intend to bring my daughter over, I do realise this benefits will affect her Visa. Currently am searching for a second job inorder to boost my finances. I was hoping to bring her November time. If i get out of the housing Benefit around September time, will that affect the application in November? Not sure if working tax is a problem? Someone please correct me.

Please advise.

Affect? Well yes, but positively. Obviously your income is higher with those benefits making it more likely that the financial test will be passed.

But do be aware about para 6C of the Immigration Rules. That is, when attempting to pass the financial test in order to get the Child Settlement visa for your daughter, it is not possible to take into account the extra benefits ... Child Benefit and Child Tax Credit ... which will be payable after she arrives in the UK. You need to pass the financial test, assuming those benefits will not be payable.

How old is your daughter?

Hello,

This is alittle bit about my situation:-

Am on ILR Thro Spouse route, we recently had differences in our marriage which ended up in us splitting up. That was in May. I was on low income so went for Housing benefit for three months. So June, July and August.

I only claimed Housing Benefit!!

Myself and hubby have sort of sorted our differences and he is coming back end of this Month(Aug). I intend to come of from housing benefit ASAP. And in the months of September I intend to put an application for settlement visa for my daughter who is abroad.

Now my worrys/question is: By the time I will be going to apply for her Visa mid September I wont be on any of the housing benefit, so in the application form I will answer am not on benefit. And my husband will be the sponsor as he earns more than myself. Though I intend to put both our payslips and Bank statements. Now the benefit that I would have received for three months be a problem? Having in Mind I wont be on that benefit any more when I will be applying for the Visa?

This is causing me nightmares and sleepless nights. Pls someone advise

You have ILR, and therefore you are perfectly entitled to claim whatever benefits your circumstances dictate you are entitled to.

I appreciate to know am entitled to them benefit, my worry is: Would it be an issue/hinderance having had claimed the benefit for three months prior to launching my daughters application, despite the fact that at that time of application I will have left???
