biometric residence permit

I was given HSMP in Oct. 2006 and extended into in Oct. 2008 so will qualify for ILR on 19/10/2011. I can apply for ILR from 22/09/11 (28 days before)

So far very straight forward case, but issue started when we and my wife lost passport early this year. Been through all the nightmare of HCI London and thought it is all over.

Applied for TOC on new passports and received biometric residence permit. Unfortunately homeoffice put valid until date on BRP as 04/09/11 (maybe as second extension letter was issued on 04/09/2008) in stead of 19/10/2011. They also did not return 2008 original extension letter.

Got in touch with them for both items as it state on letter accompanied BRP. Received acknowledgment letter saying looking into missing documents (no mention of incorrect valid until date).

It is almost a month passed and nearing to 04/09/11 bit worried. Chased them quite a few times without any luck.

Home office helpline will not state what my immigration status after 04/09/11, can someone help?
