CAN I WORK WHILE WAITING FOR DECISION OF TIER-2 VISA

Post by DMKA » Wed Nov 09, 2011 5:11 pm

Hi,

My current job under Tier-2 has ended 03/11/2011 as well as my COS. My current leave to be expired on 03/02/2012. I have already applied for new visa with sponsorship from new employer to UKBA. It seems it could take 2 months to get the decision of new application.

During this time period can I work. If so should I work part time like 20/week or I can work full time until I get my new visa decision.

If anybody has same experience, please let me know.

You may continue to work full-time with your current employer and / or take up supplementary employment in accordance with the rules.

This is not mentioned specifically in the guidance but I'll stab at a guess for you. If your remaining leave is for less than six months it will continue to be valid for that period. So one must assume you can do everything that your valid leave permits. You are allowed to work outside the scope of your sponsorship but that would have to be job of the same type and level as your current/previous job and for no more than 20 hours and not the hours that you are already committed to with your current sponsor. So you can't simple do any job; it has to be the same job.

Hi, There

I have the same situation at the moment. But the difference is my Tier2 visa has expired (as well as COS) in last week. During this waiting period can I work for previous employer doing the same job?
