Tier 2 - DEPENDANT - Extent of Evidence

Post by MB24 » Tue Oct 18, 2011 7:10 am

Hi,

I've applied as a dependant (unmarried partner) to my partners Tier 2 Sponsored visa. It's currently being processed, and I've just had an email back saying they require more evidence that we've been living together for 2+ years.

We've lived together for 3.5 years, and within the 2 year period, at three addresses. Two of those were in the UK (one month shy of two years - were there on the Tier 5).

I'm surprised they're after more, as someone I knew just had the same pass on maybe a third of the evidence I have submitted thus far. This is also fairly exhaustive as far as what we actually have, and I'm struggling to pull together much more of anything. Any ideas? Suggestions? Am I missing anything? The only real hole I can think of is literally the last couple of weeks - October 2011 - and all I can really add for that is evidence of the flight we both took back here to Australia about 10 days ago as we hadn't actually received any October dated bills or whatever before leaving the UK.

A summary of roughly what I've provided so far:

ADDRESS 1 - This address actually only accounts for about one month of the two year period, but what we are supplying covers a spread of time over 1.5yrs, up to and specifically including that specific final month. My partner lived here for a year before I moved in, and as such, we were lazy and didn't switch much over to my name or shared names, she had all the direct debits set up and I generally just transferred my share each month to her account.

- Rental agreement (her name)
- Utility bills (her name)
- Cable TV bills (my name)
- Bank statements (her name)
- Bank statements from both of us highlighting my monthly payments to her for share of rent on the property (and these show up on both our statements as such: '(MY NAME)-RENT-MAY' etc.
- Personal correspondance addressed to both of us at this address (silly things like postcards, invites etc).

ADDRESS 2 - The above address was in Australia, this address is in London, we had both moved over on the Tier 5. Almost everything here is in both names, and we kept a lot more of it. It is NOT however a monthly list, but rather a spread. It covers a December to July period, a total of perhaps ten documents, but there might have been individual months 'missing' from this - although the rental agreement and cancellation cover the full stretch, and bills, council tax etc are also spread across the whole period?

- Rental agreement (both names)
- Rental 'notice to vacate'/end of agreement (both names)
- Numerous utility bills (both names)
- Council tax (both names)
- Misc evidence (boarding passes, photos etc) showing trips taken together around Europe during this time.

ADDRESS 3 - Also London, covers July 2010 to Present. Again, almost everything in both names, quite a bit of it, but again it's a spread.

- Rental agreement, 12 months to August 2011 (both names)
- Rental extension, 12 months from August 2011 (both names)
- Numerous utility bills (both names)
- Several council tax bills (both names)
- Evidence of trips taken together (boarding passes, photos etc)
- Bank statements (her name)
- Bank statements (my name)

That, as a total, covers the required October 2009-October 2011 (it in fact covers July 2008-October 2011).

That's a lot, right? What could I be missing?

Hi, I've seen the message you posted on immigrationboards.com forum on 18/10/11 about Tier 2 dependent - extent of evidence.

I would really appreciate it if you could share your experience as my partner and I are in a similar situation.

My partner and I are both on Tier 1 Post Study VISA, living in the UK. I have a stable job and should have no difficulty applying for Tier 2 VISA, unfortunately, this is not the case with my partner. Thus he is planning to apply to be my dependent whilst I apply for my Tier 2 VISA.

Nevertheless, a lot of people (including a few immigration solicitors) have suggested that it is not possible for un-married partner to become dependent of PBS applicant although it looked as if this was possible on UKBA website. THus we are very glad to find out that another couple ( you and your partner) has already tried to apply for unmarried dependency.

We would like to find out what the outcome of your application is after you submitted a rather extensive list of evidence to support your partnership (living together for > 2 years).

Also, I would really appreciate it if you could tell us what VISA your partner was holding prior to the application and whether he/she has to leave the UK to make the application (i.e. out of country application for entry clearance). Can an in-country application be made if he holds a Tier 1 Post study work visa?

Thank you very much for your help, it is well appreciated.
