Resgistration for child with Indian Passport

Hello,

I have a quick query. I am of Indian nationality (currently under Tier 1, expiry date 22.12.12) and am applying for ILR in person next week (29.11.12). I have 3 dependents, my wife and two kids.

I have the following query:

1.I have new born son (3 weeks old), for whom I already have an Indian passport (no visa though) – can I skip his ILR application, and apply for British Citizenship straight away after we get ILR (under section 1(3)). I understand I need to use form MN1.
2.My 3 year old daughter has Tier 1 dependent visa. Can we do the same for her, or do I have to first get her ILR and then apply for BC.

Is there a phone help line which I can use?

A prompt reply will be appreciated, as I have to take a decision before next week, for my children (i.e whether to include their application for ILR).

- Was your daughter born in the UK or abroad?
- Do you plan to travel in the next 4-6 months? (I'm asking as you got a passport issued to a 3 weeks old boy so I presume you plan to travel soon).

Yes, My daughter was born in UK.

No travel plan as such, I did my son's passport in hurry as I needed for his ILR application - but later I was told that he may not need ILR and may be eligible for BC straightaway. Will having an Indian passport be an issue?

I am really onfused, as people are telling me different stories. I am panicking, as I need to take a stand, as my ILR PEO is booked on 29.11 (I have booked it for 4 person though).

Please also guide me to any link to UKBA wbsite, which I can show to the case worker in case he challenges me, as to why I am not making any ILR application for my kids. Is there any UKBA phone number too?

As the FAQ state, if you don't plan to travel and if you believe your settlement application would be granted, you don't need to include them in the application.

Nothing wrong about issuing the Indian passport. Just that if you plan to register him as British, then you could have saved the money of the passport application.

The caseworker won't ask about your kids and if he does, you can tell him you plan to register them as BC once you are granted ILR. There is no need to show him the rules. He would know them already. Many forum members have gone via this route and had no problem.
