FLR to ILR and being outside the UK

Hi,

I have married in China and my wife and I are going to apply for a Spouse's visa for settlement. I understand that the spouse's visa will get my wife an FLR and then after 23 months we can apply for her ILR.

The situation is complicated by the fact that I may be offered a role in the same company but another EU country for one year. If she came with me this would mean she stayed with me for the majority of the time in the second country. I understand this might colour the way that the authorities view her intention to settle.

Can anyone advise?

Have you looked into applying for an EEA Family Permit for your wife in China? She should apply as a non-EEA dependant of an EEA/EU citizen. This is done at the embassy in China of the EU country you will live in. It is FREE!!!!

Though you also need to apply for your right to live in that other EU country under your EEA treaty rights. This should be done using your British citizenship. It is also FREE!

These steps should allow you and your wife to live and work in any country under the EEA treaty rights.

If you just applied for a UK visa for her she would then have to apply for anotyer visa for the other EU country. The EEA Family Permit allows you both to live and work in any EU country and it is FREE!

The actual process at the embassy of another EU country might not be quite as simple as the theory. Good luck.

The EEA Family Permit does not allow spouses to change country of residence without obtaining a new permit from the new country, as far as I know.

And remember - there is no automatic access to citizenship. This depends on the local laws of the country concerned.
