ILR and passport validity

ILR and passport validity

Hi,

Looking for some help. I am about to apply for my wife's ILR following 2 yrs dependent visa (visa expiry 21/6/13).

We are applying in person on 29th May 2013 while her passport (indian) is expiring on 10th Nov 2013 (valid for 5 months 10 days on the day of application). Is it likely to be an issue or reason for refusal?
(We are applying from within the UK,she has been in the UK for last 3-4 years and has no absence issues)

Looking at UKBA website providing advice for visa application from India and Canada, it is categorically stated that applicant does not have legal requirement of 'six months passport validity'. However passport must be valid at the time of application and entry to the country. No other validity requirements are mentioned on UKBA website or SET (M) form or guidance for dependent ILR or for that matter any visa

Using common sense, no passport ever is going to be valid as long as ILR but common sense is known to avoid home office and UKBA as plague !

Indian passport renewal as tatkal is an option but no tatkal criteria mentioned and it is dependent on Indian high commission's discretion. I do not fancy applying by post and loosing it in the post or taking more than seven days. It is a gamble to go for renewal but if delayed for any reason it could lead to massive upheaval in our lives.

The validity on the passport is fine. ILR is not a sticker in the passport anymore and you can then renew passport when necessary.
